What is a MD Case Strategy?

A review of the pertinent medical records by one of our Medical Advisors and a follow up case discussion by telephone with our client and/or client counsel. A written report will be provided if requested after the case discussion.

How is this different than a Medical Record Review?

The MD Case Strategy service is designed to assist our clients with the analysis of the medical component of the claim. This service is interactive and may involve multiple telephone conversations between our Medical Advisor and our client/client counsel while a medical case strategy is developed. Whereas a Medical Record Review is a one-time “snapshot” opinion with a written report, which becomes a part of your claim file that is discoverable. A MD Case Strategy is an “off-the-record” consult that helps our client:

  •   To decide a course of action
  •   I.D. valuable missing medical records
  •   Provide insightful questions to be posed to Claimants and/or Treating Physicians
What type of specialty is the Medical Advisor?

Our Medical Advisors are “generalists” with specialties of Internal Medicine, Occupational Medicine, Family Practice and Physical Medicine and Rehabilitation.

Why not use a “like specialist”?

A “specialist” is more likely to see the case the same way as the treating doctor because they were trained the same way (e.g. surgeons see surgery as the only way to fix the problem, chiropractors see manipulation as the only way to treat musculoskeletal injuries, etc). “Specialists” tend to offer opinions that are in agreement with the “like specialty” treating doctor, in spite of any evidence to the contrary.

Why use a “Generalist”?

Our Medical Advisors have had extensive training on how to look at a case objectively and with a broad focus (all treatment options not just those used by the “specialist” treating the patient). Our experts have been trained to review medical records with a focus on evidence-based medicine, as opposed to the “assumption” basis that most treating physicians use (the patient’s word is gospel).

How long does it take to get a call from the Medical Advisor assigned to the case?

Usually within one week from receipt of the file, our Medical Advisor assigned to the case will call our client for a case discussion and to help formulate an action plan (as compared to 3-4 weeks for a written report with a “specialist”).

What’s the cost?

Our fee is hourly and there is no minimum fee. You can call with anything from a quick question to requesting an in-depth analysis of a complex medical case. The fee is based upon the time spent and is billed at $325/hr (as opposed to $500-$700/hr charged by “specialists”).

Our goal is to provide our clients with the vital medical insight necessary to help develop a medical case strategy while avoiding the need for an IME whenever possible.
